In Brief
The appellant challenged a High Court judgment in a rent dispute, arguing that the court had wrongly applied Section 11(3) of the Bombay Rent Act, 1947, as applicable in Gujarat instead of the version applicable in Maharashtra. The Supreme Court held this constituted an error apparent on the face of the judgment. The Court allowed the appeal and granted the appellant liberty to file a review application before the High Court. If the appellant could prove the error regarding territorial applicability of the statute, the High Court was directed to recall its judgment and pass a fresh order applying the correct provision applicable to Maharashtra.
