Suhas Ramchandra Apte vs Vasantrao Shankarrao Bhosle (D) Thr. Lrs

Bench: 2 — Kurian

In Brief

The appellant challenged a High Court judgment on the ground that it incorrectly applied Section 11(3) of the Bombay Rent Act as applicable to Gujarat, when the case pertained to Maharashtra where a different version of the provision applies. The Supreme Court held this constituted an error apparent on the face of the Court. Rather than deciding the case on merits, the Court disposed of the appeal by granting liberty to the appellant to file a review application before the High Court. The High Court was directed to examine whether the wrong provision was applied and, if so, to recall its judgment and pass fresh orders applying the correct provision applicable to Maharashtra.
