Sukhwinder Kumar & Ors vs State of Punjab & Ors

Bench: 2 — L. Nageswara Rao

In Brief

Appellants who completed a diploma in Medical Laboratory Technology (on matriculation qualification) prior to 2007 service rules sought appointment to posts advertised in 2011 under rules requiring Senior Secondary qualification. The High Court's interim direction to consider them failed to hold the selection process open. The Supreme Court held the appellants were ineligible under the 2007 Rules at time of advertisement and the State lawfully completed selections. However, the Court directed the State to consider appellants for unfilled vacancies from the 2011 advertisement and for 140 new posts advertised under the corrected 2016 Rules, permitting age relaxation. Appeal disposed with partial relief.
