Sukhwinder Kumar & Ors vs State of Punjab & Ors

Bench: 2 — L. Nageswara Rao

In Brief

Appellants who completed Medical Laboratory Technician diplomas based on matriculation qualification before the 2007 Rules were enacted challenged their exclusion from a 2011 recruitment based on those Rules, which prescribed Senior Secondary qualification. The High Court directed their consideration by interim order. The Supreme Court held that while the appellants suffered from an anomaly later corrected by the 2016 Rules, they were properly excluded under the 2007 Rules governing the 2011 advertisement. The State committed no illegality by completing selections without them. The Court directed the State to consider appellants for unfilled vacancies from the 2011 advertisement and the 140 posts advertised in 2016, with age relaxation if necessary."
