The High Court of Delhi had invited applications for 27 private secretary positions. After initial selection and appointment in January 2017, some candidates requested re-evaluation of their answer sheets due to alleged marking errors. A court-ordered re-evaluation of 13 candidates resulted in increased marks for all of them. The question was whether these candidates could be ranked according to their revised marks, affecting the seniority of originally appointed candidates. The Supreme Court held that candidates corrected for erroneous marking must be given notional seniority from the original appointment date based on revised marks. Originally appointed candidates who did not timely seek re-evaluation could not challenge the revised merit list reflecting corrected marks.
