Sunil @ Sonya Macchindra Ghule vs State of Maharashtra

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellant was granted bail in FIR No. 235/2010 for offences under Sections 363, 366(A) and 376 IPC. While on bail, he was arrested in another case (FIR No. 7/2012) involving serious charges including murder. He was granted bail in that case too. The Sessions Judge then cancelled his bail in the first case based on his alleged involvement in the second case. The High Court upheld the cancellation, finding misuse of bail. The Supreme Court allowed the appeal, holding that bail in one case cannot be cancelled merely because the accused is implicated in another case where he has also been granted bail. The Court set aside the cancellation order, noting that if actual misuse occurs, a separate cancellation petition in the relevant case is the appropriate remedy."
