Supreme Court of India 2021-09-29 remanded

Suraz India Trust vs Union of India

Bench: 2 — Sanjay Kishan Kaul

In Brief

This case concerns contempt of court proceedings against Mr. Rajiv Daiya, Chairman of Suraz India Trust, for his persistent attempts to scandalise the Supreme Court through disparaging remarks, frivolous public interest litigations, and threats to browbeat the judiciary. Following a 2017 order imposing Rs. 25 lakh costs and barring the Trust from filing petitions, Daiya repeatedly filed apologies claimed to be unconditional, yet continued making allegations and writing scandalous letters. The Court held that Daiya is clearly guilty of contempt, rejecting his apologies as insincere charades lacking genuine remorse. The Court reaffirmed that contempt jurisdiction protects judicial dignity, that motivated attacks on judges must be countered, and that the constitutional power to punish contempt under Article 129 cannot be diluted. The matter was remanded for hearing on final sentence."
