A school principal was dismissed based on allegations of sexual harassment, following a three-member committee inquiry. The Central Administrative Tribunal set aside the dismissal and ordered reinstatement, but the High Court reversed this. The Supreme Court found serious procedural defects: the regular CCS Rules procedures were bypassed, the appellant was never shown the inquiry report, and allegations of bias against the inquiry officer were ignored. Given the appellant's imminent retirement and these infirmities, the Court treated the termination date as voluntary retirement and directed payment of service benefits up to that date, rather than ordering reinstatement.
