Balkrishna Waman Zambare vs Siddheshwar Shikshan Sanstha, Dongarsoni & Ors

Bench: 2 — R. Banumathi

In Brief

A laboratory attendant appointed and promoted with Education Officer approval sought to challenge his termination by a school management claiming factional disputes among trustees. When he filed his appeal late, the School Tribunal granted delay condonation based on his continuous efforts to secure redress. The High Court reversed this, setting aside the condonation. The Supreme Court held that delay condonation was warranted given the sustained correspondence and duly approved appointment. The appeal was allowed, restoring the matter to the Tribunal for full adjudication on merits within six months.
