Tamil Nadu Dr. MGR Medical University vs SVS Educational and Social Trust

Bench: 2 — L. Nageswara Rao

In Brief

A homeopathic medical college sought continued affiliation from Tamil Nadu Dr. MGR Medical University to admit students. The High Court granted interim relief directing provisional admissions during the pendency of the affiliation dispute. The Supreme Court reversed this, holding that without Central Government approval under Section 12A of the Homeopathy Central Council Act, 1973, the college could not be granted affiliation. The Court affirmed that courts should not order provisional student admissions during writ petition proceedings, as dismissal exposes students to loss of academic years. The appeal was allowed and the High Court's order set aside.
