Thahira P vs Administrator, UT of Lakshadweep & Ors

Bench: 2 — Madan B. Lokur

In Brief

The Supreme Court set aside a High Court judgment striking down the appointment of Thahira as a Social Education Organizer in Lakshadweep. Although Kadeeja objected only to Thahira's educational qualification (claiming a Double Main degree was insufficient), the High Court reviewed the entire marks calculation method and declared the appointment unjustified. The Supreme Court held that courts must not stray beyond the grounds actually raised; additionally, since the university later confirmed the equivalence of Thahira's qualification and Kadeeja missed the deadline to file timely objections, strict procedural adherence was justified. The selection authority's marks weightage should not be judicially re-examined absent manifest illegality.
