Thahira P vs Administrator, UT of Lakshadweep & Ors

Bench: 2 — Madan B. Lokur

In Brief

The Supreme Court upheld the appointment of Thahira P as a Social Education Organizer in Lakshadweep, setting aside decisions by the Central Administrative Tribunal and the Kerala High Court that had struck down her appointment. Kadeeja, a competing candidate, had challenged Thahira's eligibility on the grounds that Thahira held a double-main degree (Malayalam and Sociology) rather than a single-main degree in Sociology. Kadeeja raised her objection after the prescribed deadline and did not challenge the scoring methodology initially. The Court held that it was improper for the higher forums to examine the marking method when that was not the issue Kadeeja raised, and that procedural timelines in recruitment must be respected to maintain selection integrity and finality.
