U. Manjunath Rao vs U. Chandrashekar & Anr

Bench: 2 — Dipak Misra

In Brief

A partition dispute reached the Supreme Court on appeal from the High Court's affirmance of a trial court judgment requiring rectification of a deed. The High Court had dismissed the defendant's first appeal by merely quoting trial court passages without independent analysis. The Supreme Court held that a first appellate court must give reasoned judgments showing conscious application of mind, even when affirming trial court decisions. Mere general agreement with trial court findings, without substantive analysis of facts, law, or points raised by the appellant, violates CPC rules. The Court set aside the High Court judgment and remitted the matter for fresh disposal with proper reasoned analysis.
