In Brief
A property dispute reached the Supreme Court after a High Court judgment affirmed a trial court's order for rectification of a partition deed and grant of a permanent injunction. The High Court had simply quoted from the trial court judgment without independently analyzing the evidence or addressing the appellant's substantive contentions regarding proof of the deed and existence of a joint family. The Supreme Court held that while a first appellate court need not restate all evidence when agreeing with the trial court, it must provide reasoned findings demonstrating conscious application of mind and address all issues raised by parties. The Court set aside the High Court's judgment and remitted the matter for fresh disposal with proper reasoned analysis.
