U.P. Junior High School Council Instructor Welfare Association vs State of Uttar Pradesh & Ors

Bench: 2 — Pankaj Mithal, Prasanna B. Varale

In Brief

The Supreme Court upheld teachers' rights to revised honorarium in Upper Primary Schools in Uttar Pradesh. Part-time contractual instructors appointed since 2013 at Rs.7,000/month were entitled to periodic wage increases. The Project Approval Board approved Rs.17,000/month for 2017-18, which the Court held must be implemented without reduction. The Court ruled that stagnant wages for work of a permanent nature violates constitutional principles and the Right to Education Act. It directed payment at Rs.17,000/month from 2017-18 onwards with mandatory revision at least every three years by the appropriate authority.
