Udiya was convicted of murdering his brother Nakuda by hitting him with a stone during a fight. The High Court upheld the conviction and imposed life imprisonment. The Supreme Court found this was a sudden, unpremeditated fight between brothers with no prior enmity, not a calculated murder. The stone was picked up during the scuffle, not brought as a weapon. The Court converted the conviction from murder (Section 302) to culpable homicide (Section 304 IPC) and reduced the sentence to the time already served, about six years. The appeal was partly allowed.
