In Brief
Udiya was convicted of murdering his brother Nakuda with a stone during an alleged assault in July 1999. An eyewitness saw the attack, and medical evidence confirmed head injuries caused death. The Supreme Court partly allowed the appeal. While affirming that Udiya caused the death, the Court found the incident was a sudden, unprovoked fight between brothers without prior enmity or premeditation. The Court converted the conviction from murder (Section 302) to culpable homicide (Section 304 IPC) and reduced the sentence to time already served—over six years—rather than life imprisonment.
