The Supreme Court reversed a High Court order that had directed seniority in the Indian Police Service (IPS) be determined by grade pay under the Sixth Pay Commission scheme. Officers from the Delhi and Union Territories Police Service were inducted into IPS after long service elsewhere. The High Court held that the Sixth Pay Commission Report required seniority to be based on grade pay. The Supreme Court held that seniority in IPS is determined solely by the date of induction into IPS and length of service within IPS, not by prior service or grade pay. Pay Commission Reports concern pay structure, not seniority rules. The Court set aside the High Court's directions to amend IPS regulations.
