Union of India & Ors vs Brig. Devinder Singh

Bench: 2 — UNKNOWN, UNKNOWN

In Brief

The Union of India appealed against an Armed Forces Tribunal order directing the correction of After-Action Reports and operational records regarding a military officer. The Supreme Court held that Courts and the Tribunal lack jurisdiction to direct amendments to operational reports or evaluate historical facts recorded by Armed Forces officers. Such records fall within the exclusive domain of military expertise and established Armed Forces procedures. The Court ruled it has neither the expertise nor jurisdiction to review officer-compiled reports concerning operational credit, and therefore set aside the Tribunal's direction to correct the reports. The appeals were allowed.
