Union of India & Ors vs Sandeep Kumar etc

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Union of India challenged orders of the Armed Forces Tribunal that had declined to award back wages and set aside Court Martial convictions. The Supreme Court held that the Tribunal's jurisdiction under Section 30 of the Armed Forces Tribunal Act is limited to reviewing errors of law only. The Tribunal cannot set aside convictions on other grounds or interfere with discretionary matters without identifying a specific legal error committed by the Court Martial. The Court found the Tribunal exceeded its jurisdiction and allowed the appeals, reinstating the Court Martial convictions.
