Union of India challenged a High Court order directing reinstatement of Shiba Prasad Mitra in government service with back wages. The Supreme Court, with the agreement of both parties and the Solicitor General, disposed of the appeal by a settlement. While Mitra was deemed reinstated as per the High Court order, the Court simultaneously deemed him compulsorily retired from service as of the order date. All consequential benefits from both reinstatement and compulsory retirement were to be disbursed within three months, resolving the dispute without adjudicating the merits.
