The Union of India appealed against a High Court order that upheld reinstatement of a terminated employee (Shiba Prasad Mitra) with back wages. By consent of all parties, the Supreme Court disposed the appeal by holding that the respondent shall be deemed reinstated per the original order but simultaneously deemed compulsorily retired as of the date of judgment. All consequential benefits from reinstatement and retirement were ordered to be disbursed within three months, avoiding a contested determination of the underlying merits.
