The Union of India sought to transfer a High Court Writ Petition challenging the constitutional validity of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act 2006 to the Supreme Court. The Supreme Court granted the transfer petition because another Writ Petition (Civil) No. 50 of 2008 raising the identical constitutional challenge was already pending before it under Article 32. The Court held that to avoid multiplicity of proceedings on the same statute's vires, the matter should be consolidated before the Supreme Court. The transfer petition was allowed and the High Court proceedings were transferred accordingly.
