The Supreme Court rejected claims by former employees of Uttar Pradesh Roadways for pension benefits. The Court held that these temporary department employees were not entitled to pension because they either held temporary positions or non-pensionable posts under applicable 1960 government orders. The Roadways, classified as a technical institution under civil service regulations, specifically excluded non-gazetted posts from pension eligibility. Employees who had already received alternative retirement benefits through the Employees Provident Fund Scheme could not subsequently claim pension. Government orders guaranteeing service conditions applied only to absorbed State Government servants, not temporary Roadways staff. The Court also rejected claims by employees promoted to pensionable posts after 1982, holding that prior government orders did not extend pension rights to such promotions.
