Uttar Bihar Gramin Bank & Ors vs Narendra Kumar Sinha

Bench: 2 — Abhay Manohar Sapre

In Brief

A bank dismissed an employee based on three charges of misconduct, all found proved in a departmental enquiry. After appeals and remands, the High Court's Single Judge quashed the dismissal but examined only charge two while ignoring charges one and three. The Supreme Court held that the judge must independently examine all charges. The Court set aside both the Single Judge's and Division Bench's orders and remanded the writ petition back to the Single Judge to decide the matter on full merits, while cancelling the improper remand directions to the Disciplinary Authority."
