V.G. Jagdishan vs Indofos Industries Limited

Bench: 2 — M.R. Shah

In Brief

A driver employed and terminated at the company's Ghaziabad facility later moved to Delhi and sent a termination demand notice to the employer's head office there, then filed a complaint with the Labour Court at Delhi. The employer challenged the court's territorial jurisdiction. The Supreme Court upheld the Labour Court's dismissal on jurisdictional grounds, holding that because the employee was hired, worked, and terminated at Ghaziabad, only the Ghaziabad Labour Court had jurisdiction. The location of the head office or demand notice did not create jurisdiction in Delhi.
