An employee of an ordnance factory challenged the seniority list placing him below colleagues who were appointed on the same date but promoted to skilled grade earlier because he had failed to complete probation and pass the trade test in time. The Supreme Court held that under the applicable regulations in force at appointment, seniority in the skilled grade was properly reckoned from the date of promotion to that grade, not from initial appointment. Although a later 2015 government order reversed this principle, it could not be applied retrospectively as it would unjustly disturb the settled seniority of numerous employees. The appeal was dismissed.",
