A director of a private limited company filed a suit for recovery of Rs. 25 lakh, but the plaint incorrectly described the plaintiff as the director individually rather than the company. The director sought to amend the plaint to correct this error. The trial court and high court refused the amendment, treating it as an impermissible attempt to change the suit's nature. The Supreme Court held that the error was a mere inadvertent drafting mistake and should be corrected under Order 6 Rule 17 of the CPC. The Court affirmed that procedural rules serve justice and should not be used to defeat substantive rights when the correction causes no compensable injury.
