The trial court and High Court refused to allow an amendment to correct this error, treating it as an improper attempt to convert an individual's suit into a corporate suit. The Supreme Court set aside these orders, holding that the error was an inadvertent mistake of counsel that should be corrected. The Court reaffirmed that procedural rules serve justice and should not defeat substantive rights, and amendments to correct such errors should be allowed unless they cause uncompensated injury to the opponent.
