Vidarbha Irrigation Development Corporation vs Santosh Janba Warghane and Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Vidarbha Irrigation Development Corporation sought to appeal against an enhancement of compensation made by a Reference Court in a land acquisition matter. The High Court had refused to allow the Corporation to file its appeal. The Supreme Court held that although a beneficiary cannot seek a reference under Section 58 of the Land Acquisition Act, 1894 against the Land Acquisition Commissioner's Award, it can appeal against enhancement made by the Reference Court. The Court set aside the High Court's order and remitted the matters for adjudication on merits, directing the High Court to proceed expeditiously.
