Vijay Kumar challenged a land acquisition proceeding initiated in 1959 under the Land Acquisition Act, 1894, in respect of land in Delhi. The core issue was whether non-payment of compensation causes acquisition proceedings to lapse under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The Supreme Court found that an earlier decision had already declared the proceedings lapsed for two of the three co-owners. Accepting this, the Court allowed the appeal and set aside the entire acquisition proceeding, deliberately leaving the broader legal question unresolved for future cases.
