The appellant was serving a ten-year sentence and had already spent more than seven years in prison. A co-accused in the same case had been granted bail despite being in an identical position. The Supreme Court held that because the appellant and the co-accused were similarly placed, equal treatment required the appellant's release on bail. The Court enlarged the appellant on bail subject to furnishing bail bonds of Rs. 25,000 with two sureties of the same amount, provided he was not required to be detained in any other case.
