Yakoob @ Popu vs State of Madhya Pradesh

Bench: 2 — Adarsh Kumar Goel

In Brief

In this criminal appeal arising from a murder case (death of Vijay @ Pappu and Rajjan Patel on 12.02.1997), the Supreme Court examined the convictions of two appellants, Yakub @ Popu and Johnny @ Firdaush Khan. The Court found that although they were convicted at trial, they were conspicuously absent from the two FIRs lodged immediately after the occurrence. Their names appeared only ten days later. The Court held that this significant delay in naming them, coupled with their absence from the original FIRs, created reasonable doubt about their involvement. Accordingly, the Court set aside their convictions and sentences and allowed their appeals."
