Yatin Narendra Oza vs Khemchand Rajaram Koshti and Others

Bench: 2 — Dipak Misra

In Brief

Yatin Narendra Oza, a lawyer, challenged a High Court order restraining him from making contemptuous speeches and public statements against the judiciary. The High Court had taken cognizance of unwarranted and scandalous statements made by Oza in letters and public forums. The Supreme Court found that Oza had filed unconditional apologies and undertaken not to speak on the subject in public except in court proceedings. The Court, satisfied that his repentance was sincere and his regret honest, exonerated him from the contempt charge, cautioning that any future similar conduct would constitute ex facie contempt of court.
