Adarsh Estate Sahakari Griha Nirman Sanstha Maryadit (Proposed) vs State of Maharashtra and Ors

Bench: 3 — B.R. Gavai

In Brief

Two slum dweller societies challenged a High Court order dismissing their challenges to the Slum Rehabilitation Authority's (SRA) decisions regarding housing rehabilitation schemes in Mumbai. The dispute involved three competing societies with adjacent plots. After 14 years of litigation without development progress, all parties agreed to independent rehabilitation schemes for each society. When one society later claimed to withdraw consent using a fraudulently fabricated letter with forged signatures, the Supreme Court rejected the withdrawal, upheld the authentic settlement, and directed independent development schemes for all three societies, ending the long-standing deadlock.
