Landowners sought redetermination of land compensation under the Land Acquisition Act after their land was acquired for a railway line. Some landowners first got higher compensation through court reference proceedings. The original landowners then sought equal compensation on two separate occasions: first based on the reference court's award, and second based on an even higher award from the High Court on appeal. The lower authority rejected the second application. The Supreme Court held that landowners can seek redetermination based on higher appellate court awards to ensure equal treatment among similarly-situated owners, allowing multiple applications where final awards increase through higher courts.
