The Andhra Pradesh Public Service Commission challenged a High Court order granting appointment relief to a candidate in a vacancy created when a previously selected candidate did not join. The Supreme Court held that when a candidate relinquishes his claim in writing, the Commission must remove him from the selection list and fill the vacancy through a fresh selection process following the rules then in force. The amended Rule 6 and Rule 7 must be read harmoniously to prevent rewarding candidates who had abandoned their claims. The Court found the High Court erred in ignoring the amended Rule 6's mandate, and allowed the appeal.
