Anna Juhi John and Ors vs English and Foreign Languages Universities, Hyderabad and Ors

Bench: 3 — Dipak Misra

In Brief

A student who ranked 101 in the Hyderabad campus merit list but only ranked 3 in the Lucknow campus merit list sought transfer to Hyderabad after studying at Lucknow for a year, alleging that another student (Tirna Chandra) was irregularly admitted. The Supreme Court dismissed the appeal, holding that the University's admission instructions clearly prohibit transfer between campuses both before and after admission. The Court ruled that once a candidate chooses and is allocated a campus, no flexibility is permitted merely because vacancies arise elsewhere. While the University may grant transfers in genuine exceptional circumstances (such as medical emergencies), grounds like language problems or proximity to home do not justify override of merit-based selection. The Court also held that Tirna Chandra, against whom allegations were made, was a necessary party and her absence from the proceedings barred examination of her admission in the writ petition."
