A driver suffered amputation of his right leg below the thigh in a workplace accident and was awarded only Rs.3,87,187 in compensation by the Workmen's Compensation Commissioner. The insurance company argued that benefits from a 2009 amendment could not apply retroactively to his injury. The Supreme Court held that a driver with such injuries suffers 100% functional disability and is entitled to compensation. Relying on established precedent, the Court rejected the temporal limitation argument and awarded an additional Rs.10 Lacs with interest at 12% per annum if not paid within three months.
