The Supreme Court held that such an amputation in a driver constitutes 100% functional disability. The Court affirmed that workmen's compensation amendments of 2009 apply even to accidents predating the amendment. It awarded an additional lump sum of Rs. 10 lakhs to the appellant, finding this just and proper. The insurance company was directed to pay within three months, with 12% annual interest if delayed.
