An employee was discharged from the Central Bank for falsely stating his qualifications when securing employment. While a High Court Single Judge sought to reinstate him with reduced increments, the Division Bench reversed this, upholding the discharge. The Supreme Court, invoking Article 142 of the Constitution (power to do complete justice), found discharge disproportionate to the misconduct and substituted it with reduction to his previous rank of sub-staff from the date of promotion, with reinstatement and credit for service from discharge to reinstatement (but no back-wages).
