Bharat Deep Sethi vs Sonia Takkar

Bench: 2 — R. Banumathi

In Brief

Bharat Deep Sethi, a tenant of commercial property in Delhi, challenged interim orders directing him to pay Rs. 1.25 lakhs per month as use and occupation charges. The Supreme Court held that the High Court should not have fixed interim compensation without affording the tenant a fair opportunity to contest the matter on merits and raise all contentions regarding the landlord-tenant relationship. The Court reduced the interim amount to Rs. 40,000 per month and remitted the case to the High Court for fresh consideration within three months, allowing the tenant to present all his arguments."
