Bharat Deep Sethi vs Sonia Takkar

Bench: 2 — R. Banumathi

In Brief

A tenant occupied commercial property in Delhi under an unregistered lease. The landlord filed an eviction suit, and the High Court passed an interim order directing the tenant to pay Rs.1,25,000 per month as compensation without hearing the tenant on the merits of his contentions. The Supreme Court found this unjust, as the tenant had not been afforded an opportunity to present his case. The Court reduced the interim payment to Rs.40,000 per month and remitted the matter to the High Court for fresh consideration on all substantive issues, allowing the tenant a fair hearing."
