A tailor-tenant challenged his ejectment order. The landlord sought to evict him for personal need and planned to reconstruct the building's staircase. The High Court had upheld the reversal of the Rent Controller's ejectment order. The Supreme Court remanded the matter back to the Rent Controller with directions: the landlord must provide suitable and equivalent alternative space within the same premises after reconstruction, and eviction is only permissible after the reconstruction plan is approved and the tenant cannot be accommodated elsewhere. No eviction can occur without first exhausting alternatives to house the tenant."
