Bharat Petroleum Corporation Ltd. appealed against an order setting aside disciplinary action against an employee. The employee, posted at an Air Force Station, received a charge-sheet from the Deputy General Manager for fuel tank contamination and absence from duty. The High Court had quashed the proceedings, holding the Deputy General Manager lacked authority to issue the charge-sheet. The Supreme Court reversed this, holding that the Deputy General Manager, as the Functional General Manager, was competent under the delegation of authority manual to issue the charge-sheet for 'discharge' (not 'dismissal'). The Court approved the original discharge order, finding the authority had proper jurisdiction and the proceedings were valid."
