Canara Bank challenged a High Court order that quashed a compulsory retirement order against a bank employee and remitted the case to the Disciplinary Authority for fresh inquiry. The Supreme Court held that under Regulation 5(3) of the Discipline and Appeal Regulations, 1976, the General Manager, as an authority higher than the Disciplinary Authority, had full power to impose punishment. The Division Bench erred in holding that only the Disciplinary Authority could pass such orders. The Supreme Court allowed the appeals and restored the Single Judge's order remitting the matter to the Appellate Authority for reconsideration, setting aside the Division Bench's judgment.
