The Uttar Pradesh Forest Corporation challenged a High Court order that quashed disciplinary action against an employee. The Supreme Court partly allowed the appeal. While the High Court correctly found the Disciplinary Authority violated natural justice by disagreeing with unproved charges without notice, it erred in setting aside the entire punishment order. The Court held that the recovery order of Rs.2,46,922.56 for the charge proven by the Enquiry Officer should have been maintained separately. The recovery amount was to be deducted from the employee's retirement benefits, as he had since retired from service.
