Uttar Pradesh Forest Corporation Lucknow & Ors vs Vijay Kumar Yadav & Anr

Bench: 2 — M.R. Shah, B.V. Nagarathna

In Brief

Uttar Pradesh Forest Corporation challenged a High Court order setting aside a punishment order against an employee. The Supreme Court held that while the Disciplinary Authority violated natural justice by imposing punishment for charges found not proved without issuing notice of disagreement, a charge of causing loss of Rs.2,46,922.56 that was held proved by the Enquiry Officer should be maintained. The Court partially allowed the appeal and directed that the recovery amount be deducted from the employee's retirement benefits, since the employee had since retired on superannuation.
