D.K. Sawhney (dead) Thr. Lrs. & Ors vs Union of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A commissioned officer in the Army (EME corps) was dismissed following court martial proceedings. After his death during pending litigation, his widow and children challenged the dismissal through the Armed Forces Tribunal. During the Supreme Court appeal, the government sanctioned 50% family pension to the widow. The parties accepted this settlement. The Court disposed of the appeal without deciding the merits, directing the government to quantify and pay all arrears of family pension within three months and continue monthly pension payments as per the settlement order."
