D.K. Sawhney (dead) Thr. Lrs. & Ors vs Union of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

D.K. Sawhney, a military officer commissioned in 1978, faced court martial proceedings and was dismissed from service. He challenged the dismissal by filing a writ petition before the Delhi High Court, later transferred to the Armed Forces Tribunal. During the appeal before the Supreme Court, after Sawhney's death, his legal representatives (widow, son, and daughter) continued proceedings. The Union of India issued an order sanctioning 50% family pension to the widow. The appellants accepted this settlement offer. The Supreme Court disposed of the appeal without deciding merits, directing quantification of arrears and continued monthly pension payment as per the settlement.
